Terms of Use

1. Purpose

These terms of use (the “Terms”) govern access to and use of the FoodieTom mobile application (the “Application”), published by TWILL CONSULTING. FoodieTom is a collaborative service for discovering and showcasing the best dishes served by restaurants: the Application does not rate venues, it reveals their dishes through the recommendations of its community.

2. Acceptance

Creating an account and using the Application imply full and unreserved acceptance of these Terms. Registration is restricted to adults. If you do not accept these Terms, you must refrain from using the Application.

3. Definitions

• Foodie — any person holding an account on the Application.
• Contribution — any data published by a Foodie: a recommended dish, an accompanying sentence, a report.
• Dish — a specific item served by a restaurant, the central object of recommendations.

4. Account and username

Access to contribution features requires creating an account, either with a valid email address and a password or through Sign in with Apple. You are responsible for keeping your credentials confidential and for all activity carried out from your account.

Your username must be unique, respectful, and must not impersonate a person, a brand or an official role. Misleading or inappropriate usernames may be changed or may result in the suspension of the account.

5. Code of conduct

FoodieTom relies on the sincerity of its community. By contributing, each Foodie agrees to abide by the following rules:

• Sincerity — only recommend dishes you have actually tasted and enjoyed. Recommendations must be honest and personal.
• No spam — do not publish repetitive, automated contributions or contributions unrelated to a real dish.
• No commercial promotion — the Application is not an advertising channel. Paid recommendations, insincere endorsements and self-promotion by a venue are prohibited.
• Respect for others — no insulting, defamatory, hateful or discriminatory remarks, and nothing that infringes privacy.
• Respect for moderation — cooperate in good faith with moderation and do not seek to circumvent its decisions.
• Lawful content — do not publish anything that breaks the law or infringes the rights of others (intellectual property and image rights in particular).

Failure to comply with this code may lead, depending on the seriousness and repetition of the breaches, to: a warning, the removal of the contribution concerned, the temporary suspension or the permanent deletion of the account.

6. Moderation and appeals

FoodieTom moderates contributions to preserve the sincerity of the community and their compliance with these Terms. Moderation combines prior review of published dishes and after-the-fact reporting open to everyone.

Who moderates

Review is carried out by community members entrusted with moderation, appointed by the publisher on quality criteria, and by the publisher itself. A moderator may not review their own contributions: these are handled by a third party, to guarantee impartiality.

What is subject to review

Every published dish is subject to review before it becomes visible, whether it is being created or subsequently edited. Recommendations added to an already-published dish are not subject to prior review, but remain liable to be reported and removed.

Grounds for refusal

When a dish is refused, its contributor is notified with a specific reason, chosen from:

• Duplicate — a similar dish already exists at this venue; it should have been recommended rather than recreated.
• Inappropriate name — the name contains offensive, misleading or inappropriate terms.
• Not a dish — the submitted item is not a dish within the meaning of FoodieTom (for example a service or an event).
• Other reason — specified where appropriate by the moderator.

A refusal does not erase your work: after correcting it, you can submit your dish again. If it is an edit that is refused, the dish remains published in its previous state, with no loss.

Reporting

Any Foodie may report a dish or a venue they consider to be in breach of these Terms. Reports are reviewed by the publisher, who may ignore them, correct the content, remove it or suspend the account concerned, in compliance with the applicable legal framework.

Blocking

Any Foodie may block another Foodie whose words they no longer wish to read. Blocking is personal and reversible: the blocked Foodie's words disappear immediately from the blocker's view, their recommendations still count toward dishes, and they are not notified. Every block is brought to the publisher's attention, who may review the content concerned and, where appropriate, remove it or suspend the account. Objectionable content and abusive behaviour are not tolerated.

Appeals

If you consider a moderation decision — the refusal of a dish, the removal of a contribution or the suspension of an account — to be unjustified, you may contest it by writing to contact@foodietom.com, specifying the content concerned. We will review the decision again and respond to you.

7. Contributions and intellectual property

The contributions you publish remain your property. By submitting them, you grant TWILL CONSULTING a non-exclusive, royalty-free licence, for the legal term of protection, allowing it to host, display and distribute these contributions within the Application and its services, solely for the purpose of operating them.

You warrant that you hold the rights necessary for the content you publish and that it does not infringe any third-party rights.

8. Service availability

The publisher endeavours to keep the Application available, without any obligation to achieve a particular result. The service may be interrupted for maintenance, updates or in the event of force majeure, without this giving rise to any compensation.

9. Termination and account deletion

You may delete your account at any time from the Profile screen of the Application. Deletion is immediate and permanent. Your recommendations may remain visible anonymously, in order to preserve the coherence of the dishes revealed by the community.

The publisher may terminate or suspend an account in the event of a serious or repeated breach of these Terms.

10. Liability

Contributions reflect the personal opinions of their authors. TWILL CONSULTING cannot be held liable for the accuracy of recommendations or for the use made of them. The Application is provided “as is”.

11. Personal data

The processing of your personal data is described in our privacy policy, which forms an integral part of these Terms.

12. Changes to the Terms

The publisher may amend these Terms to reflect changes to the service or to applicable regulations. The applicable version is the one in force at the time you use the Application; its date appears at the top of this document.

13. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first: write to contact@foodietom.com and we will review your complaint in good faith. The Application is provided free of charge, with no sales or paid services; the French consumer-mediation scheme is therefore not intended to apply. Should you nevertheless consider that it applies to you, the list of accredited mediators is published by the French commission overseeing consumer mediation (CECMC) at mediation-conso.fr. Failing an amicable agreement, the French courts have jurisdiction.
